5.2. Consequences of withdrawal

If you revoke this contract, we will refund all payments received from you, including delivery costs (except for the additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without delay and no later than fourteen days from the day on which we receive the notification of your withdrawal from this contract. We will use the same payment method that you used for the original transaction unless expressly agreed otherwise with you; in no case will you be charged fees for this refund. We may withhold the refund until we have received the goods back or you have provided proof that you have sent the goods back, whichever is earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the withdrawal of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. You bear the direct costs of returning the goods. For goods that cannot be returned by normal post due to their nature, these costs amount to EUR 100 for shipments from Austria, EUR 150 for shipments from Belgium, Germany, Luxembourg, the Netherlands, Hungary, Switzerland, Slovakia, Slovenia, and the Czech Republic, and EUR 250 for shipments from the remaining EU countries. You are only liable for any loss in value of the goods if this loss in value is due to handling the goods beyond what is necessary to check their condition, properties, and functioning.

The right of withdrawal does not apply to the following contracts:

  • Contracts for the delivery of goods that are not prefabricated and for whose manufacture an individual selection or determination by the consumer is decisive or that are clearly tailored to the personal needs of the consumer.

6. Delivery conditions

Deliveries are made to the delivery address provided by the customer.

Delivery is made by Austrian Post, a private parcel service, or by freight forwarder.

The delivery period is derived from the electronic catalog. Information about delivery times is non-binding unless a delivery date has been explicitly and in writing agreed upon. In any case, we deliver within the statutory period of 30 days.

In this case, the customer has the right to withdraw from the contract. If the customer withdraws or if www.lapoteriedetaize.com, owner: Charlotte Riedl-Würfel withdraws from the contract, www.lapoteriedetaize.com, owner: Charlotte Riedl-Würfel will promptly refund payments already made by the customer.

7. Retention of title

Before transfer of ownership, dispositions of the goods (resale, rental, pledge, security transfer, processing, alteration, etc.) are not allowed without the express consent of www.lapoteriedetaize.com, owner: Charlotte Riedl-Würfel not permitted.

8. Transport damage; customer's duty to inspect and notify

Delivered goods must be checked immediately for external and internal damage, or if goods with obvious damage to the packaging or contents are delivered, the customer must immediately complain to the carrier/deliverer/freight service and note the damage precisely on the delivery receipt in writing or refuse acceptance. 9. Warranty

Improper use and breach of contract are determined in particular by the manufacturer's specifications.

10. Liability

11. Prohibition of set-off and retention

The customer is not entitled to offset their own claims against claims of www.lapoteriedetaize.com, owner: Charlotte Riedl-Würfel, unless

  • the customer's claims have been offset by www.lapoteriedetaize.com, owner: Charlotte Riedl-Würfel have been acknowledged or legally established by a final court decision or
  • the customer's claims have their legal basis in the same legal transaction as the claims of www.lapoteriedetaize.com, owner: Charlotte Riedl-Würfel or
  • www.lapoteriedetaize.com, owner: Charlotte Riedl-Würfel is insolvent.

The customer is not entitled to make payments due to their own claims against www.lapoteriedetaize.com, Owner: Charlotte Riedl-Würfel to withhold, unless

12. Data protection

Data processing is carried out in accordance with legal provisions. Customer data is processed for contract fulfillment, delivery, and accounting. www.lapoteriedetaize.com, Owner: Charlotte Riedl-Würfel reserves the right to further types of data processing as far as legally permissible.

Customer data is collected, processed, used, and forwarded to commissioned partners only to the extent necessary for the establishment and execution of the purchase contract and the further business relationship between the customer and www.lapoteriedetaize.com, Owner: Charlotte Riedl-Würfel is necessary. The customer may object to this data processing due to the violation of overriding legitimate confidentiality interests arising from their particular situation at www.lapoteriedetaize.com, Owner: Charlotte Riedl-Würfel may object. All our vicarious agents are obliged to comply with the data protection law.

Invoice data is stored internally and can be requested by the customer at any time via the email address service@tzetpy.eu Information will be provided.

13. Invalid clauses

Should one or more provisions of these online terms and conditions be invalid, this shall not affect the validity of the entire contract. The invalid provision shall be replaced by the relevant statutory provision.

14. Jurisdiction and applicable law
